Terms and Conditions
These Terms and Conditions are effective from 07/05/2009, please read them carefully and fully.

My Triathlon Ltd Terms and Conditions

1. Terms

1.1 Entrant:- Person named on entry form
1.2 Entry Form:- Web or postal entry form
1.3 Event:- Lake District Triathlon
1.4 Organiser:- My Triathlon Limited (Registration No. 0606522)
1.5 Organisers Office & Registered Office:- My Triathlon Ltd, 3 Albion Grove, Sale, Manchester, M33 7TJ.
1.6 Fee:- Price detailed on the entry form including discounts or promotional offers.
1.7 Entry Credit:- A credit for entry to the next running of the event.

2. Acceptance of Terms and Conditions

2.1 The entrant by entering the event by online entry form or downloaded postal entry agrees to abide by the Terms & Conditions. The entrant acknowledges that entry to the event is solely available from the website at www.tattontriathlon.co.uk.
2.2 The organiser can change the terms and conditions if the entrant is notified by official written material or by e-mail.
2.3 The terms and conditions do not exclude the organiser’s liability for any matter which it would be illegal for the organiser to exclude (see 8.1).
2.4 The terms and conditions do not affect your statutory rights (see 8.1).

3. Limit of Liability

3.1 The Organiser shall not be liable for any loss, death, injury or damage however caused to any person or property, except where such loss, death, injury or damage is a result of the negligent acts or omissions of the organiser. Any claim to which legal liability is established shall not include damages for indirect or consequential loss.

4. Entrant

4.1 The entrant will be able to participate in the event when the full fee has been received by the organiser as cleared funds.
4.2 The minimum age for a competitor is 17years old on 31st December 2007.
4.3 The event is run under Triathlon England Rules and Regulations and the entrant agrees that they will compete under these rules. The rules and regulations are available from www.britishtriathlon.org.
4.4 The entrant acknowledges that the event is a physically demanding and strenuous endurance event. The entrant is therefore aware of the nature of the associated medical and physical risks involved.
4.5 The entrant agrees that they are physically capable of participating in the event and that they have completed the necessary training. The entrant agrees to be solely responsible for his/her actions and the organiser, its officers, employees, agents, affiliates, associated companies, sponsors or medical advisers are not responsible for any injury or illness that the entrant may suffer as a result of their participation in the event. The entrant accepts that should any medical or physical condition arise prior to the event which is likely to affect their ability to compete then the entrant will withdraw in accordance with these terms and conditions.
4.6 It is the entrant's responsibility to ensure that their equipment including bike is roadworthy and helmet complies with the Triathlon England rules and regulations.
4.7 The organiser reserves the right to disqualify or remove the entrant from the event for general misconduct, dangerous racing or other unreasonable behaviour. Should the entrant be disqualified or removed there will be no entitlement to a fee refund or a entry credit.
4.8 The organiser reserves the right to not accept or return a race entry from an individual if there is good reason to believe they will adversely affect the running of the event for other entrants or the organiser.
4.9 The entrant agrees to the organiser using images of the entrant in publicity and advertising without the need for permission from the entrant. The entrant revokes any entitlement for payments for the use of the entrant’s image.
4.10 Unless otherwise specified by the organiser swimming wetsuits are compulsory for the open water swim section. It is the entrant's responsibility to provide and use a wetsuit that complies with Triathlon England Rules & Regulations. Entrants without a wetsuit will not be allowed to compete.
4.11 All necessary race information for the event will be published on www.tattontriathlon.co.uk Please note that details of the event as published on the entry form and provisional race information is subject to change. Updated details of any alterations to race information will be made available on the web no later than 7 days prior to the event. It is the responsibility of the entrant to ensure they have accessed the relevant information on www.tattontriathlon.co.uk relating to the event.

5. Entrant Withdrawl & Refund Policy

5.1 The fee is for the event stated on the entry form and entry to another event is only possible by the issue of an entry credit from the organiser.
5.2 Entrants who are members of Triathlon England, Welsh Triathlon or Triathlon Scotland will provide valid membership cards at registration to receive their refund.
5.3 If the entrant wishes to withdraw from the event the entitlement for a refund or entry credit is as below:-

  After entry to the race is closed the entrant will recieve no refund or entry credit
  If entry to the race is open then 90 or more days before the event the entrant is entitled to a full fee refund.
  If entry to the race is open 89-30 days before the event the entrant is entitled to an entry credit to the next event if it is held.
  If entry to the race is open 29 days or less before the event the entrant will receive no refund or entry credit.

If the entrant wishes to claim a refund or entry credit they must send a written request in writing with a stamped address envelope to My Triathlon Ltd, 3 Albion Grove, Sale, Manchester M33 7TJ. The effective date for cancellation is the date of receipt by the organiser of the entrant’s cancellation letter. If the entrant fails to attend the event they are not entitled to any refund or entry credit.
5.4 The entry to the race is not transferable to another individual.

6. Event Cancellation or Alteration

6.1 The organiser reserves the right to alter the date of the event. If the entrant wishes a full fee refund they must write to the organiser’s office (see 1.5) within 30 days from the date of notification of the event date change.
6.2 The organiser reserves the right to alter the format of the event and in such a case the entrant is not entitled to a fee refund or an entry credit.
6.3 The organiser reserves the right to implement cut off times for the completion of the swim, bike and run sections to ensure the safe running of the event. If an entrant is removed from one section they will be allowed to continue the next section subject to cut off times.
6.4 The organiser can invoke force majeure should the reason be partly or fully the result of extreme weather, war, mobilisation, riots, flooding, fire, accidents, strikes, occupations, measures set by the national or local government, epidemic, non-delivery by third parties and other unforeseen events. The organiser will issue a refund net of any costs incurred to the date of cancellation.
6.5 The organiser reserves the right to cancel the event for other reasons than in 6.4 and the organiser will issue a refund to the entrant net of costs incurred to date of cancellation.

7. General

7.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts.
7.2 If any provision of these Terms and Conditions is found to be invalid by any court having jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.
